We get this question a lot: “Are your digital signatures legally accepted and binding?” And the answer is a resounding “Yes”.

With handwritten signatures having been the norm for so long prior to the wonderfully efficient digital era we now find ourselves in, there is bound to be uncertainty around new methods of validating documents, especially when it comes to important documents and contracts with legal implications.

Thankfully, the technology digital signatures are steeped in makes this method of signing the most secure method there is, above any other method conceivable. Digital signatures are essentially invisible, hashed and encrypted metadata embedded with a certificate in the file. By using a hash function, signatures are made non-invertible, meaning they cannot be reverse-engineered.

Legally Accepted Digital Signatures

Digital signatures also carry full audit trails, which shows details such as who viewed or signed the document, as well as where and when. This can also prove that a document has not been updated since it was signed.

The UK Government is incorporating an amended form of the existing eIDAS regulations on digital and e-signatures into domestic law after the withdrawal date, the Electronic Identification and Trust Services for Electronic Transactions (Amendment) (EU Exit) Regulations 2019 (SI 2019/89) (Trust Services Brexit SI) which amends and removes certain provisions around trust services that will no longer apply following the UK’s departure from the EU.
