Legality of Electronic Signatures in Papua New Guinea
The legality of electronic signatures is supported by Section 25(1) of the Electronic Transactions Act, which states that electronic signatures fulfill legal signature requirements for electronic records or data messages. Exclusions: Certain documents cannot be signed electronically, as outlined in Section 5 of the Act.
These include:
- Transactions on regulated exchanges
- Foreign exchange transactions

- Transfer of securities or financial instruments held with intermediaries
- Private law matters (e.g., marriages, divorce, wills)
- Powers of Attorney
- Trust documents (except constructive, implied, or resulting trusts)
- Documents needing notarisation
- Any documents specifically excluded by Papua New Guinea law
Equal Treatment of Signature Technologies:
Section 24 guarantees equal legal effect to all technologies used for electronic signatures, provided they satisfy the Act's requirements or other applicable regulations.
Requirements for a Reliable Electronic Signature:
Section 25(4) specifies that an electronic signature must:
- Be uniquely linked to the signatory
- Remain under the sole control of the signatory during signing
- Be alterable only in a detectable way
- Maintain the integrity of the signed information
