Electronic Signatures in Zambia
Electronic signatures in Zambia are legally recognised under Zambian law, the Electronic Communications and Transactions Act of 2021. It permits the use of electronic signatures in Zambia and regulates e-commerce transactions.
In Zambia, an "Electronic Signature" refers to data attached to, incorporated into, or logically associated with other data intended by the user to serve as a signature.
Depending on the document type, various types of electronic signatures are admissible in court. These include standard electronic signatures, digital signatures, and advanced electronic signatures (AES).
An advanced electronic signature (AES) in Zambia is created with a digital certificate obtained from an accredited Authentication Service Provider, as per the provisions of the ECTA. This typically involves a face-to-face identification process with the user and is commonly used for specific purposes, such as signing documents containing suretyship clauses.
Standard electronic signatures and digital signatures, which do not require the same level of stringent authentication, are more widely accepted in Zambia.

Legality of Electronic Signatures in Zambia
The Electronic Communications and Transactions Act of 2021 in Zambia authorises the utilisation of electronic signatures and governs e-commerce transactions. According to Section 6(2), an electronic signature retains legal validity, irrespective of its electronic format.
